Innovation Law Center

The ILC is the designated NYS Science & Technology Law Center. It is funded by the Empire State Development Corp. to provide information and research on legal issues relevant to the technology commercialization process. Research is available to early-stage companies, research centers, economic development agencies, technology transfer offices and researchers throughout New York State.  Research on the intellectual property, competitive and market landscapes relevant to a new technology are completed by law and business students under supervision of faculty. Settlement Caps NIL Payments to Student Athletes

On November 2, 2024, a federal judge granted preliminary approval for a $2.7 billion settlement in an antitrust class action involving the NCAA. If finalized, highlights include limiting NCAA schools to a maximum of $23.1 million annually in compensation for student-athletes’ name, image, and likeness (NIL), with annual increases during the ten-year settlement. A final approval hearing is scheduled for April 7, 2025. The settlement also includes provisions for NIL collectives to provide payments, contingent on compliance with NCAA rules. Dow Jones and New York Post Sue Perplexity AI Over Copyright Infringement 

This past month Dow Jones and New York Post filed a lawsuit against Perplexity AI, alleging extensive illegal copying of copyrighted material. The lawsuit claims Perplexity is unlawfully competing for readers while relying on the valuable content produced by news publishers. The case, filed in the Southern District of New York, underscores the ongoing conflict between publishers and tech companies over the use of copyrighted content in AI systems. Perplexity, which aims to disrupt the search engine market, generates summaries from various authoritative sources and promotes its ability to let users “skip the links.” The publishers argue that unlike search engines, which help users discover their work, Perplexity substitutes their content. Governor Hochul Announces Million Dollar Winners for Tenth Annual 43North Startup Competition

On October 21, 2024, Governor Kathy Hochul revealed the winners of the tenth annual 43North competition, awarding five startups $1 million each to grow their businesses in Buffalo. The competition attracted applicants from 36 countries, with the winners—CoverRight, FoodNerd, HeronAI, Rarebird, and Spiky.ai—set to relocate to Buffalo in January 2025. This year’s event celebrated a decade of supporting innovation, with 43North’s initiatives creating nearly 1,000 jobs in the region. Read more about the winners and their impact here.
