Ask the Expert Monthly Series

Do you have questions about intellectual property protection, or sorting out regulatory compliance, or how to obtain market research? The Innovation Law Center team of experts will host monthly Zoom sessions to discuss these and other issues relating to successful technology commercialization. “Ask the Expert” sessions will be held on the third Thursday of each month, starting on January 21st at noon. Submit your question in advance for an anonymous response, or just log on to hear the discussion, and ask directly. 
These zoom sessions are available via a grant from NYS ESD NYSTAR to anyone with questions regarding intellectual property, marketing, or regulatory concerns.  Our expert team will be on hand to address the many issues that come with  crossing the chasm from scientific research to technology commercialization.

New York State Science & Technology Law Center Founders Agreement Guidebook

This guidebook was compiled to provide information to developers, inventors, and entrepreneurial teams, or “founders” who are jointly evaluating the feasibility of a technology based business. The founders can be so focused on the research and development of the technology that they fail to take measures to protect the intellectual property which is key to the success of a venture. Computer Fraud and Abuse Act Applications Considered

The Supreme Court of the United States recently heard arguments in the Van Buren v. United States case. This is the first review of the Computer Fraud and Abuse Act, a federal statute that imposes civil and criminal liability for unauthorized access of computers. The government in recent years has applied the statute to increasing number of prosecutions, and this case provides the first instance of Supreme Court review. Four USPTO Intellectual Property Attachés Elevated To Rank of “Counselor”

The United States Patent and Trademark Office (USPTO) recently announced that four of its intellectual property (IP) attachés have been elevated to the diplomatic rank of “Counselor” at the U.S. embassies and missions where they serve. The USPTO’s IP Attaché Program works to improve IP systems and to help U.S. stakeholders internationally. IP attachés directly assist U.S. businesses and advocate to improve IP policies, laws, and regulations abroad. To learn more about this, click here

Developing Nations Seek Waiver of IP Rights on COVID-19 Vaccines at the WTO

The effort to address the global pandemic and eradicate COVID-19 has resulted in a number of promising vaccines. Pfizer and Moderna from the US, and AstraZeneca from the UK are a few companies that have produced vaccines and taken steps to protect the intellectual property associated with it. The WTO is considering proposals from countries such as India and South Africa to exempt vaccines from intellectual property protection. The argument is that unused manufacturing capacity in developing nations could be utilized to vaccinate more people more quickly with the exemption. Arguments against an exemption are based on preserving incentives for research and development, and the arguments for it are based on increasing the speed of access to vaccines in developing countries.  To read more about intellectual property protections and how they relate to researching COVID-19 vaccinations, click here.

New York UAS Test Site Completes Advanced Drone Operations for FAA Drone Integration Program

The New York UAS Test Site at Griffiss International Airport in Rome, New York has completed phase two of the Federal Aviation Administration’s (FAA) unmanned aircraft traffic management pilot program (UPP). Virtual collaboration for the effort began in mid-April of this year, with three weeks of live flights and component testing throughout November, pushing the boundaries of unmanned aircraft systems and enhancing Central New York’s leadership in the booming UAS industry. New York State Finalizes Regulations To Limit Greenhouse Gas Emissions

Pursuant to the Climate Leadership and Community Protection Act (CLCPA), New York State is targeting 70% renewable energy by 2030, and a zero-emission power sector by 2040. In October 2020, the Public Service Commission (PSC) expanded the state’s Clean Energy Standard (CES), buttressing the State’s measures to boost renewable energy use in New York.  The expanded CES will result in new Requests for Proposals to meet those goals. In December, the regulations will become  effective and the final regulation includes a table of all affected gases and their carbon dioxide equivalent value. GENIUS NY Now Accepting Applications for Accelerator Program

Empire State Development (ESD) announced earlier this week that the application window is now open for the fifth round of GENIUS NY– the world’s largest business accelerator competition focused on unmanned systems. ​CenterState CEO’s Tech Garden in Syracuse will invest $3 million in five finalist companies. FuzeHub / Manufacturing Reimagined Grants

FuzeHub is offering grants of up to $10,000 each to support projects in which a New York State manufacturer participates in one of FuzeHub’s “Manufacturing Reimagined” workshops[CRS1]  or webinars and receives technical assistance from a NYSTAR Innovation Asset. Assets are the 70+ university-based or not-for-profit centers supported by Empire State Development’s Division of Science, Technology & Innovation (NYSTAR). They provide a broad range of capabilities and expertise in manufacturing competitiveness and emerging technologies. A list of potential partners is available by working with FuzeHub staff to help manufacturers identify the best-fit resource for their specific needs.


2021 CNYBAC Medical Device Innovation Challenge

CNYBAC will select up to 5 MDIC US-based teams who receive intensive mentorship by quality, regulatory, CEO and other experts throughout the 6-month program. Teams may elect to participate virtually or receive free work space on-site within the CNYBAC Creation Garage with access to our Stratasys F170 3D Printer and shared equipment. New York Forward Loan Fund

New York Forward Loan Fund (NYFLF) is a new economic recovery loan program aimed at supporting New York State small businesses, nonprofits and small landlords as they reopen after the COVID-19 outbreak and NYS on PAUSE. Save the date for the upcoming New York State Innovation Summit on November 8 – 9, 2021. The event, which is hosted by FuzeHub and part of the NYSTAR annual meeting, is aimed at New York State startups, developers, manufacturers and businesses looking to showcase and discover new and emerging technologies that support innovation and drive business growth. The Summit will celebrate the state’s leadership in technology-fronted economic growth and feature expert speakers in biotechnology, energy information, artificial intelligence and many other industries.
